Introduction
This Refund & Cancellation Policy explains the conditions under which Muto Studio provides refunds, accepts cancellations, and terminates services.
By purchasing or using our services, you agree to the terms outlined in this Policy, in addition to our Terms & Conditions and any applicable Service Agreement, Proposal, or Statement of Work (SOW).
1. Project-Based Services
Project-based services include, but are not limited to:
- Website Design & Development
- Software Development
- Mobile Application Development
- Branding & Visual Identity
- UX/UI Design
- eCommerce Development
- AI Solutions
- Digital Strategy
- Custom Integrations
Unless otherwise agreed in writing, projects begin once the required initial payment has been received.
2. Non-Refundable Deposits
Project deposits secure production capacity, planning resources, and project scheduling.
For this reason:
- Initial deposits are non-refundable once work has commenced.
- Deposits compensate for planning, research, discovery, project management, and resource allocation.
- If work has not yet started, Muto Studio may, at its sole discretion, approve a partial or full refund.
3. Client Cancellation
Clients may cancel a project at any time by providing written notice.
If cancellation occurs:
- All completed work performed up to the cancellation date will be invoiced.
- Outstanding invoices become immediately due.
- Completed deliverables paid for by the Client will be transferred after all outstanding balances have been settled.
- Work not yet performed will not be invoiced.
4. Cancellation by Muto Studio
Muto Studio reserves the right to suspend or terminate services when:
- Invoices remain unpaid.
- The Client materially breaches the agreement.
- Required information or approvals are repeatedly withheld.
- The Client requests activities that are illegal, unethical, or outside the agreed scope.
- Abusive, threatening, or inappropriate conduct is directed toward our personnel.
Whenever reasonably possible, advance notice will be provided.
5. Monthly Services
Monthly services may include:
- Digital Marketing
- SEO
- Paid Advertising Management
- Website Maintenance
- Hosting Management
- Technical Support
- AI Automation Support
- Content Management
Monthly agreements automatically renew according to the applicable Service Agreement unless terminated in writing.
Either party may terminate recurring services by providing 30 days’ written notice, unless otherwise specified in the applicable agreement.
6. Subscription Billing
Subscription fees are billed in advance for each billing period.
Once a billing cycle has started:
- Charges are generally non-refundable.
- Services remain available through the end of the paid billing period unless otherwise agreed.
7. Change Requests
Clients may request changes during a project.
Changes outside the approved scope may require:
- Additional fees.
- Revised timelines.
- A formal Change Order.
- A revised Statement of Work.
Muto Studio will communicate the impact of requested changes before implementation.
8. Client Delays
Projects depend on timely collaboration.
If required materials, approvals, or feedback are delayed by the Client:
- Project timelines may be adjusted.
- Production schedules may be rescheduled.
- Additional fees may apply if significant re-planning becomes necessary.
Projects inactive for more than 60 consecutive days may be considered abandoned.
Reactivation may require a new project schedule and additional setup fees.
9. Third-Party Services
Many projects rely on third-party products and services, including:
- Webflow
- Shopify
- WordPress
- Meta
- Stripe
- HubSpot
- Cloudflare
- Hosting providers
- Domain registrars
- Software licenses
Fees paid directly to third-party providers are governed by their own refund and cancellation policies and are generally non-refundable through Muto Studio.
10. Digital Deliverables
Due to the nature of digital services:
- Completed design work
- Source code
- Digital assets
- Creative deliverables
- Consulting services
- Strategy sessions
- Workshops
- AI-generated deliverables
are generally non-refundable once delivered.
11. Refund Eligibility
Refund requests are evaluated individually.
Factors considered include:
- Work completed.
- Contractual obligations.
- Project status.
- Payments received.
- Applicable laws.
Approved refunds, when applicable, will generally be processed using the original payment method.
12. Force Majeure
Neither party shall be liable for delays or inability to perform resulting from circumstances beyond reasonable control, including but not limited to:
- Natural disasters
- Government actions
- Internet outages
- Cybersecurity incidents
- Labor disputes
- Pandemics
- Utility failures
Project schedules may be adjusted accordingly.
